Your Use of our Site constitutes your agreement to follow and be bound by the Terms of Use. These terms of use include require binding arbitration on an individual basis to resolve disputes. Lola Kastor disclaims all warranties of any kind, either express or implied, including without limitation, implies warranties of merchantability and fitness for a particular purpose. Lola Kastor does not warrant that your use of this website will be uninterrupted or error free, or that this site or its server are free of viruses or other harmful elements. Although Lola Kastor endeavors to provide accurate information, it does not warrant or make any representations regarding the accuracy or reliability of information on this website. Your use of the website is at your own risk. Neither Lola Kastor nor its affiliates or vendors or content providers shall be liable to any person or entity for any direct or indirect loss, damage (whether actual, consequential, punitive, special or otherwise), injury, claim, or liability of any kind or character whatsoever based upon or resulting from your use or inability to use this website, or any information or materials provided on the website. Lola Kastor is not liable for any defamatory, offensive or illegal conduct of any user. If you are dissatisfied with the website or any materials on the website, or with any of Lola Kastor’s terms of use, your sole and exclusive remedy is to discontinue using the website. You agree to indemnify, defend and hold harmless Lola Kastor, its officers, employees, distributors, vendors and affiliates from and against any and all third-party claims, demands, liabilities, costs or expenses, including reasonable attorneys’ fees, resulting or arising out of your breach of any of these terms of use. Certain provisions of the foregoing paragraph may not apply to summers within the state of New Jersey or in other jurisdictions where prohibited by law.  

User ideas, feedback, comments, submissions

All ideas, feedback, comments, suggestions, and other submissions disclosed, submitted or offered to Lola Kastor on or by this website or otherwise disclosed, in connection with the use of our website (collectively, “comments”) shall be and remain Lola Kastor property. 

Disputes 

Lola Kastor is ready to assist you with questions and concerns.  Please email lolakastor@lolakastor.com. In the event that our customer service members is unable to resolve your concern, by using our Website you unconditionally agree that all claims relating to your access or use of our Website, including all disputes arising out of, or related to, any products or services purchased from Lola Kastor through our Website, will be resolved entirely through binding individual arbitration, rather than in court. You may also assert individual claims in small claims court if your claims otherwise qualify. The Federal Arbitration Act and federal arbitration law apply to this agreement. 

Payment Methods

We accept all major credit cards.  Your credit card will be charged at the time of purchase, and an order confirmation within 24 hours.  Applicable sales tax will be charged on all orders shipping to California, Colorado, New York, or Washington addresses.  Shipping cost may be charged separately if the order is being shipped internationally.  

Return Policy

We do not offer refunds since all orders are made to order.  We will only offer a store credit on any incorrectly manufactured garment; meaning, visual wear appeal.  All garments are meticulously inspected for shape and wear appeal. Due to the nature of the manufacturing of the garment, minor imperfections may be slightly noticeable but considered normal. 

Shipping Policy

All orders are shipped via FED-EX or UPS to physical address, no P.O. Box.  All orders require delivery signature to ensure delivery.  The shipping price will be automatically added to your order if order is being shipped within the US.  If the order is to be shipped outside of the US, Hawaii, Puerto Rico, we will confirm shipping cost in order confirmation email sent to you when order is placed.  Please contact lolakastor@lolakastor.com for assistance to file a claim on your order.  Lola Kastor cannot accept responsibility for any packages lost, stolen or damaged in transit.
